Mackenzie District Plan Review: Proposed Plan Changes 28, 29 and 30, Variations, and Designations

Pursuant to Clause 5 of the First Schedule and section 169 of the Resource Management Act 1991, the Mackenzie District Council (the Council) gives public notice of proposed Plan Changes 28, 29 and 30, associated Variations, and the Designations Chapter, to the Mackenzie District Plan.

These form Stage 4 of the review of the Mackenzie District Plan and have been drafted in accordance with the National Planning Standards.

The Plan Changes introduce new chapters to the Mackenzie District Plan, outlined further below. The Plan Changes and Variations introduce zones, overlays, specific control areas and other layers and amendments to the Mackenzie District Plan EPlan Maps. The Plan Changes and Variations also propose to delete or amend the PDF Mackenzie District Plan provisions and PDF Maps that are to be replaced by the plan changes.

Plan Change 28, Variation 1 to Plan Change 26, and Variation 1 to Plan Change 27

Plan Change 28 – Hazards and Risks, Historic Heritage and Notable Trees proposes to add the following chapters to the Mackenzie District Plan:

  • Contaminated Land (CL), Hazardous Substances (HAZS), Natural Hazards (NH), and Hydro Inundation (HI) within a new Hazards and Risks Section of Part 2 – District Wide Matters.
  • Chapters and Schedules for Historic Heritage (HH) and Notable Trees (TREE), within the Historical and Cultural Values Section of Part 2 – District Wide Matters.

Amendments are proposed to the following chapters of the Mackenzie District Plan:

  • New Definitions and the application of existing definitions, and new Abbreviations within the Interpretation Section of Part 1 – Introduction and General Provisions.
  • The Renewable Electricity Generation Chapter (REG) and the Infrastructure Chapter (INF) within the Energy, Infrastructure, and Transport Section in Part 2 – District Wide Matters, being Variation 1 to Plan Change 26.
  • The Subdivision Chapter (SUB) within the Subdivision Section and Earthworks Chapter (EW) within the General District-Wide Matters Section in Part 2 – District Wide Matters, being Variation 1 to Plan Change 27.

Plan Change 29, Variation 1 Plan Change 23, Variation 2 to Plan Change 26, and Variation 2 to Plan Change 27

Plan Change 29 – Open Space and Recreation Zones, Noise, Signs and Temporary Activities proposes to add the following chapters to the Mackenzie District Plan:

  • Noise (NOISE), Signs (SIGN), and Temporary Activities (TEMP) within the General District-Wide Matters Section in Part 2 – District Wide Matters.
  • Natural Open Space Zone (NOSZ), Open Space Zone (OSZ), and Sport and Active Recreation Zone (SARZ) within a new Open Space and Recreation Section of Part 3 – Area Specific Matters.

Amendments are proposed to the following chapters of the Mackenzie District Plan:

  • New Definitions and the application of existing definitions, and new Abbreviations within the Interpretation Section of Part 1 – Introduction and General Provisions.
  • Light Chapter (LIGHT) within the General District-Wide Matters Section of Part 2 – District-Wide Matters.
  • Takapō / Lake Tekapo Precinct Chapter (PREC1) within the Precincts (Multi-Zone) Section in Part 3 – Area-Specific Matters.
  • The Natural Character Chapter (NC) within the Natural Environment Values section in Part 2 – District-Wide Matters, being Variation 1 to Plan Change 23.
  • The Renewable Electricity Generation Chapter (REG) and the Infrastructure Chapter (INF) within the Energy, Infrastructure, and Transport Section in Part 2 – District Wide Matters, being Variation 2 to Plan Change 26.
  • The Earthworks Chapter (EW) within the General District-Wide Matters Section in Part 2 – District Wide Matters, being Variation 2 to Plan Change 27.

Plan Change 30, Variation 2 Plan Change 23, Variation 3 to Plan Change 26, and Variation 3 to Plan Change 27

Plan Change 30 – Special Purpose Zones proposes to add the following chapters to the Mackenzie District Plan:

  • Pūkaki Village Special Purpose Zone (PVSPZ), Pūkaki Downs Special Purpose Zone Chapter (PDSPZ), Glentanner Special Purpose Zone (GSPZ), Airport Special Purpose Zone (AIRPZ), and Accommodation Special Purpose Zone (ASPZ) Chapters in the Special Purpose Zones Section of Part 3 – Area Specific Matters.

Amendments are proposed to the following chapters of the Mackenzie District Plan:

  • New Definitions and the application of existing definitions, and new Abbreviations within the Interpretation Section of Part 1 – Introduction and General Provisions.
  • Takapō / Lake Tekapo Precinct Chapter (PREC1) within the Precincts (Multi-Zone) Section of Part 3 – Area-Specific Matters.
  • APP1 – Height in Relation to Boundary within the Appendices Section in Part 4 – Appendices and Maps.
  • The Natural Character Chapter (NC) within the Natural Environment Values Section in Part 2 – District-Wide Matters, being Variation 2 to Plan Change 23.
  • The Infrastructure Chapter (INF) within the Energy, Infrastructure, and Transport Section in Part 2 – District Wide Matters, being Variation 3 to Plan Change 26.
  • The Subdivision Chapter (SUB) within the Subdivision Section and Earthworks Chapter (EW) within the General District-Wide Matters Section in Part 2 – District Wide Matters, being Variation 3 to Plan Change 27.

Designations Chapter

A Designations Chapter is proposed in a new Designations Section of Part 3 – Area Specific Matters. Most designations are being rolled over into this Chapter without modification. Three designation alterations are proposed, and 26 new designations are proposed.

Submissions

Any person may make a submission. Where a person can gain advantage in trade competition through a submission, then the person may only do so if the person is directly affected by an effect of the Plan Change that adversely affects the environment; and does not relate to trade competition or the effects of trade competition.

The closing date for lodging a submission is 5.00pm, Wednesday 22 January 2025.

Submissions must be in the format prescribed by Form 5 and must state whether or not you wish to be heard on your submission. All information in the submission is public information. Paper submission forms are available at the Council Offices in Fairlie and Twizel.

Once the closing date for submissions has passed, Council will publicly notify all submissions received, prepare a summary of submissions, and will allow a period for further submissions in support of, or in opposition to, those submissions already made.
Council hearings for Plan Changes 28 – 30, associated variations, and designations will then be arranged to consider all submissions. Anyone who has made a submission and indicated that they wish to be heard will have the right to attend the hearings and present their submission.

Any person who has made a submission has the right to appeal against the decision to the Environment Court if in relation to a provision or matter that is the subject of the appeal, the person referred to the provision or matter in the person’s submission on the proposal.
